LEGAL NOTICE AND GENERAL POLICY NOTICE

This Legal Notice applies to root-gardening.com, all pages and materials published by RootedGardening, and all written policies incorporated into the RootedGardening website.

RootedGardening is an independent online retailer.

2. Ecommerce Platform

The RootedGardening online store is hosted using Shopify’s ecommerce platform.

Shopify supplies technical and payment-related infrastructure but is not the seller, manufacturer, supplier, installer, or shipper of products offered by RootedGardening.

Purchases made through the Site create a transaction between the customer and RootedGardening, subject to our Terms of Service and applicable law.

3. Policies Covered by This Notice

This Legal Notice applies together with all RootedGardening policies, including:

We make reasonable efforts to provide accurate product information. However, product details may originate from manufacturers, suppliers, fulfillment partners, or other third parties.

Dimensions;

Labeling;
Accessories;

Product appearance.

Measurements may be rounded, converted between measurement systems, or subject to reasonable manufacturing tolerances.

Decorative plants, soil, flowers, pots, furniture, tools, and accessories appearing in product images are not included unless expressly identified as included.

10. Gardening and Growing Disclaimer

Information published by RootedGardening is provided for general product and gardening information.

It is not a substitute for advice from a qualified:

Landscaper;

Contractor;
Pest-control professional;
Medical professional; or
Other appropriately licensed or qualified adviser.

Plant health and growing results vary according to climate, soil, drainage, sunlight, water, fertilizer, pests, disease, plant selection, and maintenance.

RootedGardening does not guarantee particular plant growth, germination, yield, flowering, survival, or pest-control results unless a written product warranty expressly states otherwise.

11. Product Safety Notice

Gardening products must be selected, assembled, installed, maintained, and used appropriately.

Customers should:

Follow all manufacturer instructions and warnings;
Inspect products and hardware before use;
Use appropriate protective equipment;
Obtain help when lifting or assembling heavy products;
Anchor tall, hanging, wall-mounted, lightweight, or wind-exposed products appropriately;
Keep sharp tools, batteries, cords, small parts, and packaging away from children and pets;
Confirm that balconies, railings, walls, floors, shelves, fences, and mounting surfaces can support the intended weight;
Check local codes and property restrictions; and
Stop using a product that appears damaged, unstable, overheated, or unsafe.

Planters and raised beds become substantially heavier after being filled with soil and water. Customers are responsible for confirming that the intended surface can support the completed weight.

Customers should not mount, suspend, or place products above people, pets, vehicles, or valuable property unless the installation is appropriate and secure.

12. Battery and Power-Tool Notice

Battery-powered tools and outdoor equipment may involve sharp blades, cutting mechanisms, moving parts, electrical components, and rechargeable batteries.

Such products should be used only by capable adults who have reviewed the applicable instructions and warnings.

Customers must not:

Use an incompatible charger or battery;
Charge a damaged, swollen, leaking, wet, or overheated battery;
Disable a safety guard or switch;
Operate a cutting tool near children, pets, bystanders, or unsecured materials;
Use electrical equipment in wet conditions unless it is specifically rated for that use; or
Modify a battery, charger, blade, motor, or safety component.

Protective equipment may include eye protection, gloves, hearing protection, suitable footwear, and fitted clothing, depending on the product and task.

13. Third-Party Fulfillment Notice

RootedGardening may use independent suppliers, warehouses, carriers, and logistics providers to fulfill customer orders.

This means products may:

Ship from different facilities;
Arrive in separate packages;
Be delivered by different carriers;
Display a warehouse or logistics-provider address;
Use supplier-provided packaging; or
Have separate tracking information.

The use of third-party fulfillment does not create a direct contract between the customer and an unidentified supplier.

The Site may link to carrier websites, payment providers, social-media services, manufacturers, or other third-party resources.

These links are supplied for convenience. RootedGardening does not control and is not responsible for third-party:

Content;
Products;

Security;
Availability;
Statements;
Terms; or
Privacy practices.

A link does not automatically represent an endorsement or commercial affiliation.

15. No Unauthorized Representations

No supplier, carrier, influencer, affiliate, independent contractor, customer-service representative, or other third party may modify RootedGardening’s written policies or create a warranty on our behalf unless the modification or warranty is expressly authorized in writing by RootedGardening.

Informal statements should not be interpreted as changing a published policy unless RootedGardening expressly confirms the change in writing for the applicable transaction.

16. Errors and Availability

The Site may occasionally contain typographical mistakes, incomplete information, pricing errors, broken links, inventory discrepancies, or outdated content.

RootedGardening may correct errors and update information without prior notice.

We may cancel or correct an affected transaction where permitted by law. If payment has been collected for an order that we cancel, we will refund the canceled amount to the original payment method.

17. No Waiver of Consumer Rights

Nothing in any RootedGardening policy is intended to eliminate, disclaim, shorten, or restrict a consumer right that cannot legally be waived.

Where a disclaimer, limitation, deadline, remedy, or other policy term is inconsistent with mandatory law, it will apply only to the maximum extent legally permitted.

18. Severability

If a court or other authority finds a portion of this Legal Notice or another RootedGardening policy invalid or unenforceable, the affected language will be limited or removed to the minimum extent necessary.

The remaining provisions will continue in effect.

19. No Waiver

RootedGardening’s decision not to enforce a provision in one situation does not waive its right to enforce that provision in another situation.

A waiver is effective only when expressly made in writing by an authorized representative of RootedGardening.

20. Governing Law

This Legal Notice and the RootedGardening policies are governed by the laws of the State of Alabama, subject to mandatory consumer laws that may apply based on a customer’s location.

Venue for disputes will be determined under the Terms of Service and applicable law.
