TERMS OF SERVICE

1. Overview

This website is operated by RootedGardening, doing business as RootedGardening (“RootedGardening,” “we,” “us,” or “our”). Throughout these Terms of Service, the terms “Site” and “website” refer to root-gardening.com, including its content, features, products, and services.

RootedGardening offers this Site, including all information, tools, products, and services available through it, conditioned upon your acceptance of these Terms of Service and all other policies posted on the Site.

By visiting the Site, creating an account, placing an order, submitting content, or otherwise using any portion of the Site, you agree to be bound by these Terms of Service. If you do not agree, you must not access or use the Site.

Our Privacy Policy, Shipping Policy, Return and Refund Policy, Legal Notice, and any other policies posted on the Site are incorporated into these Terms by reference.

2. Eligibility

You must be at least the age of majority in your state or place of residence to make a purchase through the Site.

By using the Site, you represent that:

You have the legal capacity to enter into a binding agreement;
The information you provide is accurate and complete;
You will use the Site only for lawful purposes; and
You will not use our products or services in violation of any applicable law.

Products purchased through the Site are intended for lawful personal or household use unless we agree otherwise in writing.

3. Shopify Platform

Our online store is hosted through Shopify, which provides the ecommerce platform that enables us to offer products and services to you.

RootedGardening is the seller of products purchased from our store. Shopify is not the seller, manufacturer, supplier, shipper, or warrantor of our products and is not responsible for fulfilling RootedGardening orders.

Your use of payment methods or services supplied by Shopify or another third party may also be subject to that provider’s separate terms and privacy practices.

4. Products and Product Information

RootedGardening offers gardening products that may include planters, raised garden beds, watering equipment, garden tools, plant supports, outdoor décor, greenhouses, crop-protection products, and battery-powered outdoor equipment.

We make reasonable efforts to describe and display products accurately. However:

Product colors may appear differently depending on your screen;
Measurements and weights may have reasonable manufacturing tolerances;
Packaging, finishes, hardware, accessories, or minor design details may change;
Natural materials such as wood may vary in color, grain, texture, and appearance; and
Product images may include plants, soil, decorations, tools, or other staging items that are not included unless specifically stated in the product description.

You are responsible for reviewing the complete product description, dimensions, materials, included components, assembly requirements, care instructions, and compatibility information before purchasing.

We may modify product descriptions, prices, specifications, availability, or other information at any time. Such changes will not affect an order we have already accepted unless necessary to correct an obvious error or comply with law.

5. Supplier Fulfillment

Some RootedGardening products may be stored, packaged, or shipped directly by third-party fulfillment partners or suppliers.

By placing an order, you acknowledge that:

Products in the same order may be fulfilled from different locations;
An order may arrive in more than one package;
Packages may arrive on different days;
Packaging or shipping labels may identify a fulfillment facility or logistics partner;
Tracking information may be issued separately for each package; and
Product availability may occasionally change before fulfillment is completed.

RootedGardening remains your point of contact for orders placed through the Site. Questions about an order should be directed to us rather than to an unidentified supplier or return address shown on a package.

6. Prices, Taxes, and Payment

Unless stated otherwise, prices are listed in U.S. dollars.

Prices, promotions, and discounts may change without notice. A price displayed on the Site does not constitute an accepted offer until we accept and process your order.

Applicable taxes, shipping charges, and other fees will be shown at checkout when required. You authorize us and our payment processors to charge the payment method provided for the full amount shown at checkout.

You represent that:

You are authorized to use the payment method submitted;
Your billing and payment information is accurate; and
You will promptly update information that changes.

We may correct pricing, description, discount, or calculation errors. If an error affects an order you have already submitted, we may contact you for instructions or cancel and refund the affected order.

7. Order Acceptance and Cancellation

An order confirmation acknowledges that we received your order. It does not necessarily mean that the order has been accepted or shipped.

We reserve the right, where permitted by law, to limit, reject, or cancel an order for reasons including:

Product unavailability;
Incorrect pricing or product information;
Suspected fraud or unauthorized payment activity;
Shipping restrictions;
An incomplete or undeliverable address;
Supplier or inventory errors;
Unusually large quantities that appear intended for resale; or
A violation of these Terms.

If we cancel an order after payment has been collected, we will issue a refund to the original payment method for the canceled amount.

Requests to change or cancel an order must be submitted promptly. Because orders may be sent to fulfillment partners shortly after purchase, we cannot guarantee that an order can be modified or canceled after it has been submitted.

8. Shipping and Delivery

Orders are shipped in accordance with our Shipping Policy, which is incorporated into these Terms.

Delivery dates are estimates unless we expressly state that a specific delivery date is guaranteed. Carrier delays, weather, peak-season demand, customs processing, address problems, supplier interruptions, and other circumstances may affect delivery.

You are responsible for providing a complete and accurate delivery address and for ensuring that the location can safely receive the package. Additional restrictions may apply to oversized products, remote locations, apartment buildings, gated communities, post-office boxes, and military addresses.

Title and risk of loss transfer as provided by applicable law. Nothing in these Terms limits any nonwaivable rights you may have concerning goods lost or damaged before delivery.

9. Returns, Refunds, and Exchanges

Returns, refunds, replacements, and exchanges are governed by the Return and Refund Policy posted on the Site.

Do not mail a product to an address appearing on the original package unless RootedGardening has specifically authorized that return address. Supplier and fulfillment-center addresses may not accept customer returns.

Products returned without authorization may be refused, lost, or returned to the sender and may not qualify for a refund.

Your statutory consumer rights, where applicable, are not limited by our Return and Refund Policy.

10. Product Inspection and Damage Reporting

Inspect each shipment promptly after delivery.

If a product arrives damaged, defective, incomplete, or materially different from what you ordered, contact us as soon as reasonably possible. Include:

Your order number;
A description of the issue;
Photographs of the product;
Photographs of the shipping carton and label; and
Photographs of any damaged or missing components.

Keep the product and its packaging until we provide instructions. Discarding packaging or attempting a repair before contacting us may make it more difficult to verify carrier or supplier damage, but it will not eliminate rights that cannot legally be waived.

11. Assembly, Installation, and Product Safety

Many RootedGardening products require assembly, installation, anchoring, charging, maintenance, or adult supervision.

You agree to:

Read and follow all instructions, labels, warnings, and manuals;
Confirm that the product is appropriate for its intended location and use;
Use suitable tools, protective equipment, and assistance during assembly;
Check that fasteners, supports, anchors, batteries, blades, guards, and electrical components are secure before use;
Keep tools, batteries, sharp components, small parts, and packaging away from children and pets;
Follow local building, electrical, fire, water-use, rental-property, homeowners-association, and safety requirements; and
Stop using a product if it appears damaged, unstable, overheated, unsafe, or improperly assembled.

Raised beds, trellises, arches, greenhouses, plant stands, hanging planters, wall-mounted planters, and similar products must be placed or anchored appropriately for their size, load, surface, wind exposure, and local conditions.

Power tools and battery-powered equipment must be used only by capable adults in accordance with the manufacturer’s instructions. Do not modify safety guards, batteries, chargers, blades, switches, or electrical components.

RootedGardening does not provide professional landscaping, engineering, electrical, construction, horticultural, pest-control, or medical advice.

12. Plants, Soil, Watering, and Growing Results

Individual growing results depend on factors outside our control, including climate, soil, light, water quality, watering practices, pests, plant selection, planting depth, drainage, nutrition, and maintenance.

We do not guarantee that a particular product will cause a plant to grow, flower, produce fruit, survive a particular climate, or remain free from pests or disease.

Soil meters, watering systems, propagation products, greenhouses, and similar products are consumer gardening aids. Their readings or performance should not be treated as professional laboratory, agricultural, engineering, or safety determinations.

13. Personal Information

Your submission and our processing of personal information are governed by our Privacy Policy.

You agree to provide current, complete, and accurate account, billing, shipping, and contact information. You are responsible for safeguarding account credentials and for activity conducted through your account.

Notify us promptly if you believe your account or payment information has been used without authorization.

14. Reviews and Other User Content

If you submit a review, photograph, comment, suggestion, testimonial, or other content, you grant RootedGardening a worldwide, nonexclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, translate, display, distribute, and create derivative works from that content for business, promotional, operational, and marketing purposes.

You represent that your submission:

Is truthful and based on your genuine experience;
Does not infringe another person’s rights;
Does not contain unlawful, defamatory, threatening, obscene, deceptive, or malicious content;
Does not contain malware or harmful code; and
Does not disclose another person’s private information without permission.

We may moderate or remove user content, but we are not obligated to publish or retain every submission.

15. Intellectual Property

The Site and its original content—including text, graphics, logos, branding, page designs, photographs, videos, product curation, and written materials—are owned by or licensed to RootedGardening and are protected by applicable intellectual-property laws.

You may use the Site only for personal, noncommercial shopping purposes. You may not, without prior written permission:

Copy or republish substantial portions of the Site;
Scrape, harvest, or systematically extract Site data;
Use our content to create competing product listings or stores;
Remove copyright, trademark, or ownership notices;
Use RootedGardening branding in a way that suggests authorization or affiliation; or
Sell, license, distribute, or commercially exploit our content.

Product names, photographs, specifications, and trademarks belonging to manufacturers or suppliers remain the property of their respective owners.

16. Third-Party Links and Services

The Site may contain links to third-party websites, apps, carriers, payment providers, tracking services, or social-media platforms.

We do not control third-party services and are not responsible for their content, availability, security, accuracy, or privacy practices. A link does not necessarily mean that RootedGardening endorses or is affiliated with the third party.

Your use of a third-party service is governed by that provider’s terms.

17. Prohibited Conduct

You may not use the Site:

For an unlawful, fraudulent, abusive, or deceptive purpose;
To violate intellectual-property, privacy, publicity, or other rights;
To submit false payment, identity, account, or delivery information;
To interfere with the Site’s operation or security;
To introduce malware, automated attacks, or harmful code;
To scrape or harvest data without authorization;
To impersonate another person or business;
To make fraudulent refund, replacement, chargeback, or non-delivery claims;
To resell Site access or content without authorization; or
To assist another person in prohibited conduct.

We may suspend access, cancel affected orders, preserve records, or cooperate with payment providers and lawful authorities when reasonably necessary.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis.

Except for warranties expressly provided in writing or warranties that cannot legally be excluded, RootedGardening disclaims implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not warrant that:

The Site will always be available, secure, or error-free;
Product descriptions or images will be entirely free from minor errors;
Every product will remain continuously available;
Delivery will occur on a particular date unless expressly guaranteed; or
Products will produce particular gardening, landscaping, or growing results.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent legally permitted.

19. Limitation of Liability

To the fullest extent permitted by law, RootedGardening and its owners, officers, employees, contractors, affiliates, service providers, licensors, and fulfillment partners will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of the Site or products.

Where legally permitted, our total liability for a claim relating to a purchased product will not exceed the amount you paid for the product giving rise to the claim.

These limitations do not exclude or limit liability that cannot legally be excluded, including liability for fraud, willful misconduct, or personal injury to the extent applicable law prohibits such a limitation.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless RootedGardening and its owners, officers, employees, affiliates, contractors, service providers, licensors, and fulfillment partners from third-party claims, liabilities, damages, and reasonable expenses arising from:

Your unlawful use of the Site;
Your material violation of these Terms;
Your infringement of another person’s rights; or
Your intentional misuse or unauthorized modification of a product.

This provision does not require you to indemnify a party for that party’s own unlawful conduct or negligence where such indemnification is prohibited.

21. Termination

We may suspend or terminate your access to the Site if we reasonably believe you have materially violated these Terms, engaged in fraud, threatened the Site’s security, or created legal exposure for RootedGardening.

Obligations and liabilities incurred before termination will survive. Provisions that by their nature should survive—including intellectual property, disclaimers, liability limitations, and governing law—will remain effective.

22. Governing Law

These Terms and transactions with RootedGardening are governed by the laws of the State of Alabama, without regard to conflict-of-law rules.

Any dispute shall be brought in a court with lawful jurisdiction serving Mobile, Alabama unless applicable consumer law gives you the right to bring a claim elsewhere.

Nothing in this section deprives a consumer of mandatory protections available under the law of the consumer’s place of residence.

23. Severability and No Waiver

If any part of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will continue in effect.

Our failure to enforce a provision on one occasion is not a waiver of our right to enforce it later.

24. Entire Agreement

These Terms, together with the policies and notices incorporated by reference, constitute the entire agreement between you and RootedGardening concerning use of the Site and purchases made through it.

If a product page or written promotion contains a specific term that conflicts with a general provision of these Terms, the more specific term will control for that product or promotion, subject to applicable law.

25. Changes to These Terms

We may update these Terms to reflect changes in our operations, products, services, technology, or legal obligations.

The revised Terms will be posted on this page with an updated effective date. Changes apply prospectively unless otherwise stated or legally required.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms.
